How Louisiana Visitation Rights Work

Louisiana Civil Code Article 136(A) gives a parent who isn’t granted custody the right to reasonable visitation unless a court finds, after a hearing, that visitation wouldn’t be in the child’s best interest. That standard, set out in Civil Code Article 134, accounts for factors including each parent’s emotional ties to the child, their capacity to provide care, the stability of each home, and whether each parent supports the child’s relationship with the other.

Courts may restrict or deny visitation when there is evidence of abuse, family violence, or other serious risk. In those situations, supervised visitation may be ordered, with a neutral third party or designated agency monitoring visits. Relocation adds another layer of complexity: a custodial parent who wants to move more than 75 miles from their current residence must give the other parent at least 60 days’ written notice, and if the move is opposed, the court holds a hearing to determine whether relocation serves the child’s best interests before any existing visitation schedule is altered.

Grandparent Visitation Rights in Louisiana

Grandparents don’t automatically lose access to a grandchild when a family fractures, but court-ordered visitation requires meeting specific legal thresholds. Under Louisiana Civil Code Article 136(B), grandparents may petition for visitation when the parents are unmarried or not cohabitating, or when the parents have filed for divorce, provided the court finds access is in the child’s best interest. Louisiana Revised Statute 9:344 provides an additional avenue when one parent is deceased, interdicted, or incarcerated, or when the parents of a married child have lived apart for at least six months and extraordinary circumstances exist.

Courts weighing grandparent visitation under Article 136(D) consider the length and quality of the existing relationship, the child’s need for the guidance a grandparent can provide, the child’s preference if the child is of sufficient maturity to express one, and the mental and physical health of both the child and the grandparent. Louisiana courts must also balance these claims against a fit parent’s constitutionally protected right to direct their child’s upbringing. The burden falls on the grandparent to show that visitation is reasonable and in the child’s best interest.

Enforcing & Modifying Visitation Orders in Calcasieu Parish

A court order means nothing if the other parent won’t follow it. When a co-parent refuses to honor a visitation schedule, the aggrieved parent can file a rule to show cause before the court that issued the original order. If the violation is proven, the court may impose sanctions including make-up visitation time, fines, and other remedies. Modification follows a different standard. The requesting party must generally show a material change in circumstances since the original order was entered and that the proposed change is in the child’s best interest.
