Louisiana Laws & Penalties for Prescription Drug Charges
Louisiana law distinguishes among several forms of conduct involving prescriptions and medication. A legend drug is a medication that legally requires a prescription. Louisiana Revised Statutes 40:1060.15 prohibits knowingly or intentionally obtaining possession of a legend drug through misrepresentation, fraud, forgery, deception, or subterfuge.
A conviction under that statute carries up to six months in jail and a fine of up to $500. The exact consequences depend on the charged offense, the evidence, and other case-specific factors.
Louisiana Revised Statutes 40:971.2 separately addresses knowingly assisting in obtaining a controlled dangerous substance through misrepresentation, fraud, forgery, deception, or subterfuge. It also covers certain conduct involving fictitious people or businesses. The statute provides for up to five years of imprisonment and a possible fine of up to $50,000.
Depending on the allegations, a case may also involve possession, attempted acquisition, distribution, prescription forgery, or counterfeit or imitation controlled substances. We identify the statute actually charged rather than assume every prescription-related investigation carries the same penalties.
