Louisiana doesn’t treat aiding and abetting as a separate charge. Under La. R.S. 14:24, anyone who aids, abets, counsels, or procures another person to commit a crime is charged as a principal and punished the same as the person who carried out the act, whether or not they were present when it occurred. Principals vs. Accessories: A Critical Distinction

Not every participant in a crime faces the same legal exposure. Louisiana law separates two distinct roles, and the difference has significant sentencing consequences.

Under La. R.S. 14:24, all persons concerned in the commission of a crime, whether present or absent, who directly commit the act, aid and abet in its commission, or counsel or procure another to commit it, are principals. A principal is charged and sentenced as though they committed the underlying offense themselves.

An accessory after the fact is different. La. R.S. 14:25 applies to someone who, after a felony is committed, harbors, conceals, or assists the offender with knowledge of the crime and the intent to help them avoid arrest, trial, or punishment. That’s a standalone offense carrying a fine of not more than $500 and imprisonment of not more than five years, capped at no more than half the maximum penalty the principal offender faces. It’s a serious charge, but it’s a different legal category from being charged as a principal.

Determining which charge applies, and whether the facts actually support either one, is where the defense analysis starts.

What the State Must Prove in a Principal-Liability Case

To convict someone as a principal under Louisiana law, prosecutors generally must establish two things: that the person had the intent to further the crime, and that they took some action to participate in it. Circumstantial evidence can satisfy that standard, which means the bar for an initial charge is lower than many people expect.

What the state can’t rely on alone is mere presence. Being at the scene of a crime, without evidence of intent or active participation, isn’t enough to establish principal liability. That distinction matters when evaluating whether a charge has the evidentiary support to survive a challenge.
