Louisiana’s Legal Standard for Modifying a Court Order

Louisiana courts don’t modify existing orders simply because one party wants different terms. Before a judge can consider any change to custody, child support, or spousal support, the party seeking modification must demonstrate a material change in circumstances since the original order was entered.

Custody Modification Standards

For custody matters, the burden of proof depends on how the original order was entered. If it was a consent decree, meaning both parties agreed, the standard is comparatively lower. If the original order was a considered decree, entered after a judge weighed evidence at a hearing or trial, the higher Bergeron standard applies. Under Bergeron v. Bergeron, 492 So. 2d 1193 (La. 1986), the parent seeking modification must show either that continuing the current custody arrangement is so harmful to the child as to justify a change, or prove by clear and convincing evidence that the harm likely caused by a change of environment is substantially outweighed by its advantages. Courts take this threshold seriously.

In all custody and visitation modifications, the court’s primary focus remains the best interests of the child under Louisiana Civil Code article 134, which lists the factors a judge must weigh.

Child Support Modification Standards

For child support, a material change typically exists when the recalculated amount under current guidelines would differ from the existing order by 25% or more, or when the order was last set more than three years ago. One important rule: voluntary underemployment doesn’t reduce a parent’s obligation. Courts impute income based on earning capacity, not what a parent chooses to earn.

Circumstances That Can Support a Modification Petition

Meeting the material change threshold requires real, documented changes in your life or your co-parent’s life. Courts in Calcasieu Parish recognize a range of circumstances as potentially qualifying:

• Job loss or significant income change: A substantial drop in income, a new disability, or a major increase in either parent’s earnings can warrant revisiting a child support order.
• Parental relocation: A move out of state or more than 75 miles within Louisiana requires at least 60 days’ written notice to the co-parent. If the move is opposed, a contradictory hearing can be required to determine whether the relocation serves the child’s best interests.
• Changes in the child’s needs: New medical diagnoses, shifts in educational requirements, or significant emotional needs that the current order doesn’t address can support a modification request.
• Failure to follow the existing order: A pattern of one parent ignoring the custody or visitation schedule is a recognized basis for seeking modification.
• Remarriage or cohabitation: These events can affect spousal support eligibility and may also be relevant to a custody evaluation.
• Military deployment: A deployment requiring a temporary custody arrangement may form the basis for a modification proceeding.

One point that surprises many clients: informal agreements between parents about custody or support aren’t legally enforceable. Only a court-approved modification order carries the force of law. If you and your co-parent have been operating under a handshake arrangement, the court still holds you to the original order.

The Modification Process in Calcasieu Parish
