Federal Drug Statutes That Apply in Lake Charles Cases

Federal drug prosecutions in the Western District of Louisiana most commonly proceed under three sections of the Controlled Substances Act. Understanding the charges means understanding what each one actually requires.

21 U.S.C. § 841: Manufacturing, Distribution & Possession with Intent

Section 841 is the core federal drug trafficking statute. It makes it unlawful to knowingly manufacture, distribute, or dispense a controlled substance, or to possess one with intent to do any of those things. Distribution under this statute doesn’t require money changing hands. Transferring drugs to another person or moving them through a courier can both satisfy the element.

21 U.S.C. § 846: Conspiracy

A conspiracy charge under Section 846 requires only an agreement between two or more people to commit a drug trafficking offense. The penalties mirror those for the completed offense, and most federal courts don’t require proof of a concrete step toward carrying out the plan. Co-conspirators can be held responsible for the full scope of the operation, even conduct they didn’t personally take part in.

21 U.S.C. §§ 960 & 963: Import & Export Offenses

Sections 960 and 963 of the Controlled Substances Import and Export Act govern drug importation and exportation. The penalty structure largely tracks Section 841, meaning the same quantity-based tiers and mandatory minimums apply. Section 963 extends conspiracy liability to import and export offenses the same way Section 846 does for domestic trafficking.

Mandatory Minimum Sentencing in Federal Drug Cases

Federal drug sentencing under Section 841(b) is organized into quantity-based tiers. Depending on the drug type and amount, those tiers typically carry five-year or ten-year mandatory minimum prison terms. If death or serious bodily injury resulted from the drugs at issue, the mandatory minimum can rise to 20 years.

Quantity thresholds are generally calculated on the total weight of the mixture containing the drug, not just the pure substance. Methamphetamine is one exception, with separate thresholds for mixture weight and pure weight. Because the mixture-weight rule can capture small amounts of a drug diluted in a larger substance, the quantity that triggers a mandatory minimum is sometimes lower than it appears.

The Safety Valve & First Step Act

The safety valve provision under 18 U.S.C. § 3553(f) is generally the only mechanism that lets a federal judge sentence below an otherwise applicable mandatory minimum in a drug case. To qualify, a defendant must meet specific criteria, including a limited criminal history and full cooperation with the government. Not every defendant is eligible, and the analysis is fact-specific.

The First Step Act of 2018 reformed how prior drug convictions trigger sentencing enhancements. Before the Act, defendants with two or more prior felony drug convictions faced mandatory life sentences in some circumstances. The Act raised the threshold required to trigger the most severe enhancements and narrowed the definition of qualifying prior offenses. For defendants with prior records, whether those changes apply is a critical part of any federal defense strategy.
